Shore Protection Act Permit #431

This serves as notification from the Shore Protection Committee and the Georgia Department of Natural Resources of a request from DKH, LLC to modify Shore Protection Act Permit #431under O.C.G.A. 12-5-230 et. seq. at 3407 Menendez Lane, Sea Island, Glynn County, Georgia. 

Shore Protection Act Permit #431 was issued on February 27, 2015 for the construction of 423 square feet of a residential pool and installation of 2,076 square feet of landscaping.  In addition, the property consisted of 140 square feet of an existing rock revetment for a total of 2,639 square feet of impacts within the jurisdiction of the Shore Protection Act.

 

The modification of Shore Protection Act Permit #431 includes expanding the terrace surrounding the authorized residential pool, adding a wood (Ipe) path, and resurfacing the existing concrete beach crossover located on the existing rock revetment. 

 

The lot is approximately 19,687 square feet (0.45 acres), of which, approximately 2,639 square feet (0.06 acres) are located within SPA jurisdictional area.  The proposed addition terrace would impact 76 square feet. The proposed wood (Ipe) path would occupy 637 square feet. This would increase the permitted impacts from 563 square feet to 1,276 square feet within the jurisdiction of the Shore Protection Act.  Approximately 1,363 square feet or approximately 52% of state’s jurisdictional area will be maintained in an existing or improved vegetative and topographic condition.

 

It is the responsibility of the applicant to demonstrate that the project is not contrary to the public interest and that no feasible alternative sites exist. In passing upon the application for permit, the permit issuing authority shall consider the public interest which for purposes of this part shall be deemed to be the following considerations:  (1) Whether or not unreasonably harmful, increased alteration of the dynamic dune field or submerged lands, or function of the sand-sharing system will be created; (2) Whether or not the granting of a permit and the completion of the applicant's proposal will unreasonably interfere with the conservation of marine life, wildlife, or other resources; and (3) Whether or not the granting of a permit and the completion of the applicant's proposal will unreasonably interfere with reasonable access by and recreational use and enjoyment of public properties impacted by the project.
